Jerusalem and Los Angeles, August 8 - one wonders how legal and Information Systems (IS) experts would bet on Hagai Brenner's next move in the cases, related to the late Moshe Silman.  On August 5 Registrar/De Facto District Judge Hagai Brenner was requested to disqualify himself, based on material concern of Fraud in the electronic Public Records of the District Court by Hagai Brenner and others...

Based on past experience in the California and federal courts in the United States, in the Tel-Aviv District Court itself, and in the Supreme Court of  Israel, the following four bets are offered:
a)  Hagai Brenner WILL disqualify himself.
b)  Hagai Brenner will NOT disqualify himself.
c)  Hagai Brenner will refuse to rule on the Request
d)  ALL THE ABOVE, combined, through the issuance of a simulated, fraudulent paper as "Decision" on the Request for Disqualification.  Like other decisions of this kind - since implementation of Net Ha-Mishpat - it is likely to be an electronic, unsigned, "Post-It Decision",  which is never served on the parties (unauthenticated), and fails to appear in the online public access system of the District Court (not entered into the Public Record).

Pending before the District Court in the related cases, in addition to the Request for Disqualification, are:

  • Request to Inspect and to Copy the District Court's records, and
  • Request for Certified Copies of Decisions/Judgments.
Pursuant to new Regulations of the Courts and Supreme Court of Israel decisions over the past decade, a request to inspect and to copy court records must be granted by the judge, who presides in the case itself.

The 2012 submission of Human Rights Alert to the Human Rights Council of the United Nations, regarding the State of Israel, titled "Integrity or lack thereof, of the electronic record systems of the courts of the State of Israel," is scheduled for review in early 2013.

IBM and EDS, US-based corporations, were involved in the implementation of the fraudulent electronic record systems of the State of Israel over the past decade .  Similar systems had been implemented in the state and federal courts in the United States a couple of decades earlier.  The 2010 submission of Human Rights Alert to the Human Rights Council (HRC) of the United Nations, regarding the United States, was reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to "corruption of the courts and the legal profession and discrimination by law enforcement in California."
