In the course of the military operations in Gaza so far more than 500 people were killed, mostly Palestinians, and thousands were wounded. Among the Palestinian deaths more than 80 children, and according to UN estimates about 70% of the deaths are among civilians. July 20th was the deadliest day in Gaza, and in Shaja'iya lone at least 17 children were killed and 14 women. Photographs from the area show that some of the civilian were killed, while escaping from the battle ground.
The death and destruction in Shaja'iya expose a serious picture of the situation in Gaza.
One must ask: How can an operation against military targets and the fighting itself justify such widespread and deadly military actions against an entire civilian neighborhood and its inhabitants.

במסגרת המבצע הצבאי בעזה נהרגו עד כה למעלה מ-500 בני אדם, רובם פלסטינים, ונפצעו אלפים. בין ההרוגים הפלסטינים יותר מ-80 ילדים ועל פי הערכות האו"ם, שיעור ההרוגים האזרחים עומד על כ-70 אחוזים. ב-20.7 היה היום הקטלני ביותר בעזה ובשכונת שג׳אעיה בלבד נהרגו לפחות 17 ילדים ו-14 נשים. בצילומים מהשטח נראה כי חלק מהאזרחים נהרגו במנוסתם מאזור הקרבות.
ההרג והחורבן הרב בשג׳אעיה חושף תמונת מצב קשה על הנעשה ברצועת עזה. נשאלת השאלה - כיצד הפעולה נגד אותן מטרות צבאיות או הלחימה עצמה מצדיקות פעולה צבאית כה רחבה וקטלנית כלפי שכונה אזרחית שלמה, על תושביה?

אתמול, הוצאנו יחד עם ארגוני זכויות אדם שותפים מכתב ליועץ המשפטי, יהודה וינשטיין, בעקבות דיווחים על הפגיעות הקשות באוכלוסייה האזרחית ותקיפת יעדים אזרחיים במסגרת מבצע "צוק איתן".

בסיום המכתב, בו פרטנו את המקרים המדאיגים במיוחד מהשבועות האחרונים, דרשנו מהיועמ״ש ליישם את הדברים הבאים:
1. להורות לדרג המדיני והפיקודי האחראי על הפעלת הכוחות להימנע מנקיטת פעולות שעלולות להפר את דיני הלחימה, ובפרט להימנע מפעולות שמעלות חשד להפרות חמורות של דינים אלו.
2. לעדכננו אם וכיצד התקיימה ביקורת אפקטיבית על הייעוץ המשפטי של הפרקליטות הצבאית במסגרת מבצע "צוק איתן" ואם בכוונתו לבחון את חוקיות מדיניות התקיפה כפי שהתגבשה.
3. לפעול להקמת מנגנון חקירה חיצוני, עצמאי ואפקטיבי לבחינת החלטות והנחיות הדרג המדיני והפיקודי לגבי אופן ניהול הלחימה.

Since the beginning of operation Protective Edge, more than 500 people have been killed, the majority of which are Palestinians, and thousands were injured. More than 80% of the dead Palestinians are children and According to estimates provided by the United Nations, civilian casualties constitute 70% of the deaths in Gaza.

The 20th of July was the deadliest day in Gaza, in which at least 17 children and 14 women were killed in the neighborhood of Shujaya alone. According to photographs from the field, it appears that some of the civilians were killed while attempting to flee the area of the battle.
The death and destruction in Shujaya neighborhood exposes a shocking image of the situation in Gaza. The question remains - how does an action against military targets or the combat itself justifies such broad and deadly military action against an entire civilian neighborhood and its resident?

Yesterday, we sent a joint letter, along with nine other human rights organizations, to the Israeli Attorney General, Yehuda Weinstein, following the release of reports on the nature of attacks within the Gaza Strip and the high rate of civilian casualties.

At the end of the letter, in which we described a few of the most concerning cases that occurred in the Gaza strip in recent weeks, we demanded from the Attorney General the following things:
1. To instruct the political and command leadership responsible for commanding the troops to refrain from taking actions that may violate the laws of war, and specifically activities that raise suspicion of severe violations of these laws.
2. To update us as to whether and how an effective review by the Attorney General of the Military Advocate General has been conducted during Operation Protective Edge, and whether you intend to examine the legality of the offensive policy.
3.To act to establish an external, independent, effective investigation mechanism to investigate decisions and guidelines of the political and command leadership regarding the manner the war has been conducted.
