Your written response within 14 days is kindly requested.

Dear Attorney Bar-El:

Yesterday, while sitting with other activists outside the Tel-Aviv police station, where Tax Authority whistle-blower Rafi Rotem was being interrogated, I again noticed that some referred to Mr Rotem's recent meetings with staff of the office of the State Ombudsman as "providing testimony".

In contrast, I could not find any such reference in written documents, pertaining to the same meetings, which were issued by the State Ombudsman's office before or after the same meetings.

Since you participated in at least some of these meetings as Mr Rotem's Counsel, since you are the CEO of a public, non-profit organization, whose mission is fighting corruption, I kindly request your legal opinion in this matter:

Were you witness to any procedure, conducted during the above referenced meetings, which constituted "providing testimony", pursuant to the law of the State of Israel?

For example, was any affidavit, pursuant to the law of the State of Israel, signed by Mr Rotem during any of these meetings?

Needless to say, the issue is central for the understanding by Mr Rotem's supporters of the nature of current conduct of the office of the State Ombudsman relative to Mr Rotem's case.

אתמול, בשעה שישבו פעילים מחוץ לתחנת משטרת תל-אביב, בה נחקר באותה שעה רפי רותם - חושף השחיתויות ברשות המסים - שמתי לב שוב, שיש המתייחסים לפגישות האחרונות של מר רותם עם אנשי משרד מבקר המדינה כ"מסירת עדות".

לעומת זאת, לא מצאתי התייחסות כזאת בכתובים שהונפקו על ידי משרד מבקר המדינה לגבי אותן פגישות, הן לפני קיומן והן לאחריהן.

מאחר שאתה השתתפת לפחות בחלק מפגישות אלה כבא-כוחו של מר רותם, ומכיוון שאתה יו"ר של עמותה ציבורית למלחמה בשחיתות, אבקש את חוות דעתך המשפטית בעניין זה: 
האם היית עד להליך כלשהו, שהתנהל בפגישות הנ"ל, שהיה "מסירת עדות" בכפוף לחוקי מדינת ישראל? 
לדוגמה, האם חתם מר רפי רותם על תצהיר בכפוף לחוקי מדינת ישראל במהלך פגישות אלה? 

אין צורך להכביר מלים - עניין זה הוא מרכזי לצורך הבנה על ידי הפעילים בקבוצת התמיכה, מהו טיבה של התנהלותו העכשווית של משרד מבקר המדינה ביחס למר רותם.

2014-08-15 Liveleak.com censors posts on judicial corruption in the United States...

The phenomenon is not new.  Posts that document judicial corruption both in the US and Israel are treated by the "moderators" in manners that result in no readership.
The post on the submission of the draft Human Rights Alert (NGO) to the State Department was uploaded yesterday, but today there are 0 views and 0 comments.  Typically, within a few hours there are at least a couple of hundred reads and at times a dozen comments or more (often nasty comments as well...).

Over the years I have posted noumerous legal records on my Scribd.com archive. [1]
And over the years, I have periodically published on this blog the Scribd.com archive stats of overall readership, and readership per record. [2-5]
Most recently, the read counts were around 1,000 and at times 2,000 per day. [2]
And the total read counts on the archive reached over 1.4 millions.
The service also provided readership per day for any period you selected, with detailed readership per record during the same period.
And then, Scribd.com decided to improve its stats page: [3]

Wondering what happened to your 'My Stats' page? We've made a big change to it recently which may come as a surprise. Here's what's going on: Scribd's made it easier for one and all by simplifying the whole page and reporting system. Now, we'll be better at consistently reporting the information to you and you'll still be able to easily see how many views your work on Scribd are getting whenever you want. 
And with the implementation of the New "My Stats" Page:
  • You can no longer view the readership per day.
  • You can no longer view the readership per record in a given time period.
  • The total "reads" on the archive over its lifetime dropped more than 10 fold - to 117,000! That is less reads than I head in mid 2010, a few months after launching the site...  [5]

Somehow, it appears counterproductive for a business, which persumably profits from the reading of records it maintains, to make a mistake of this nature...
