OccupyTLV, September 1 – in response to recent requests to inspect the court files in the cases of Amos Baranes and Roman Zadorov, the State Prosecution objected, raising claims of “privacy”:
  • In the case of the late Amos Baranes - there is large body of public records, indicating that police and prosecutors engaged for years in serious misconduct in order to win his false conviction and prevent his re-trial.
  • In the case of Roman Zadorov - there is a growing body of evidence of similar conduct, continuing to this date...
In view of the State Prosecution's claims of “Privacy Rights”, to prevent inspection of the records, Joseph Zernik, PhD, asked Attorney Tamar Paroush, Supervisor of Criminal Matters in the State Prosecution, to clarify the State Prosecution's position:
Are policemen and/or prosecutors entitled to any Right for Privacy, as a cause for denying inspection and imposing prohibition of publication of court records, which provide evidence of their conduct while performing their duties, which should be deemed criminal?

RE: Baranes v State of Israel (3032/99) and Zadorov v State of Israel (7939/10) – is policemen's and prosecutors' conduct, maliciously perverting justice while performing their duties, covered by the Right for Privacy?
Your response within 14 days is kindly requested.

Dear Attorney Parush:
In relationship to my Request to Inspect, your objection on behalf of the State Prosecution, and the January 31, 2000 Request for a New Trial in the court file, referenced above [1,2] - serious concerns must be raised that the State Prosecution employed false claims of “Right for Privacy” in an attempt to wrongfully prohibit inspection and publication of a court records, which documents policemen's and prosecutors' misconduct in the Amos Baranes affair.
The picture, which emerges from the Request for a New Trial, filed by the late Public Defender David Weiner and others, indicates that a large group of policemen and prosecutors engaged in conduct, which included extraction of confession and reconstruction of murder through the use of wrongful methods, providing false testimonies in courts, and “systematic concealment of the truth in court”.
The intention of such policemen and prosecutors, as indicated by the Request for a New Trial, was to stand as “a fortified wall” in an effort to pervert Due Process and Fair Hearing, and obstruct justice. All that – in order to convict an innocent person of murder and prevent his acquittal in a new trial.
Given the number of policeman and prosecutors involved, their coordinated conduct, the duration of years, and the number of court processes in the matter, a reasonable person would most likely conclude that it was organized crime by policemen and prosecutors in the courts.
Therefore, your April 25, 2015 response on behalf of the State Prosecution, objecting to my Request to Inspect the court file, referenced above, raises the following fundamental question:
Is policemen's and prosecutors' conduct, maliciously perverting justice while performing their duties, covered by the Right for Privacy, as a cause for denying inspection and imposing prohibition of publication of court records?
Such question is of the highest public policy significance today in the State of Israel, when over half a dozen most senior commanders of the Israel Police have been demoted or resigned in relationship to various corruption or sex offense investigations in recent years, when about half the public is shown in polls to consider the Israel Police “corrupt”, when former Tel-Aviv District State Attorney Ruth David is prosecuted in a major corruption scandal, and when State prosecutors are engaging in labor strikes in an effort to prevent the establishment of a public authority for supervising their conduct.
Above and beyond all that, the question is current and urgent, since the evidence points out that a large group of policemen and prosecutors has engaged for years in similar conduct in the Roman Zadorov affair, and the State Prosecution objected to inspection of court records in Zadorov v State of Israel (7939/10) under similar claims of the Rights for Privacy... Therefore, I would be grateful for your response, regarding the State Prosecution position in this important public matter.

* במקרה של עמוס ברנס - ראיות מרובות מצביעות על כך שאנשי משטרה ופרקליטות עסקו במשך שנים בהתנהלות פסולה במטרה להביא להרשעת שווא ולמניעת זכויו במשפט חוזר. 
* במקרה של רומן זדורוב – הראיות מצטברות להתנהלות דומה הנמשכת עד היום...
לנוכח התואנות של פרקליטות המדינה לגבי "זכות הפרטיות", במטרה למנוע עיון ופרסום כתבי בית דין, הוגשה בקשה לעו"ד תמר פרוש, הממונה על עניינים פליליים בפרקליטות המדינה, להבהיר את עמדת הפרקליטות:
האם עומדת לאנשי משטרה ו/או פרקליטות הזכות לפרטיות, כעילה לשלילת זכות העיון ולהטלת איסור פרסום על כתבי בית דין, הכוללים ראיות להתנהלותם במסגרת מילוי תפקידם, שיש לראות בה התנהלות פלילית?

בדיקת בקשתי לעיין, התנגדותך בשם פרקליטות המדינה, והבקשה למשפט חוזר מיום 31 לינואר, 2000, בתיק ברנס נ מדינת ישראל (3032/99) [1,2] - מעלה חשש כבד שפרקליטות המדינה השתמשה בתואנה של "הזכות לפרטיות" בנסיון לאסור שלא כראוי עיון ופרסום כתבי בית דין, המתעדים התנהלות פסולה של אנשי משטרה ופרקליטות בפרשת עמוס ברנס.
התמונה העולה מתוך הבקשה למשפט חוזר, שהוגשה על ידי בא כוח הסנגוריה הציבורית דוד וינר ז"ל ואחרים, מצביעה על קבוצה גדולה של אנשי משטרה ופרקליטות, שעסקו בין השאר בגביית הודאה ושחזור הרצח תוך שימוש באמצעים פסולים, במתן עדויות שקר בבתי המשפט, וב"הסתרה שיטתית של האמת".
כוונתם של אנשי משטרה ופרקליטות אלה, כפי שהיא מתבררת מתוך הבקשה למשפט חוזר, הייתה לעמוד "כחומה בצורה" במטרה לשבש הליך ראוי ושימוע הוגן ולעוות את הדין. כל אלה – במטרה להרשיע חף מפשע ברצח ולמנוע את זיכויו במשפט חוזר.
לנוכח מספר אנשי המשטרה והפרקליטות שהיו מעורבים בעניין והתיאום ביניהם, לנוכח משך השנים של התנהלותם זאת, ולנוכח מספר ההליכים המשפטיים בהם היו מעורבים, קרוב לוודאי שאדם בר דעת יסיק שמדובר בפשיעה מאורגנת של אנשי משטרה ופרקליטות בבתי המשפט.
לפיכך התנגדותך מיום 25 לאפריל, 2015, בשם פרקליטות המדינה על בקשתי לעיין בתיק שבנידון מעלה את השאלה העקרונית:
האם התנהלותם של אנשי משטרה ופרקליטות, העוסקים בעיוות הדין בזדון בעת מילוי תפקידם, נכללת בזכות לפרטיות, כעילה לשלילת זכות העיון ולהטלת איסור פרסום על כתבי בית דין?
לשאלה זאת חשיבות ציבורית מן המעלה הראשונה במדינת ישראל היום, כשיותר מחצי תריסר ניצבים הודחו או פרשו בקשר לפרשיות שחיתות או עבירות מין, כשסקרים מראים שכמחצית הציבור רואה את המשטרה כ"מושחתת", כשפרקליטת מחוז ת"א לשעבר עומדת למשפט בפרשת שחיתות חמורה, וכשאנשי הפרקליטות נוקטים בעיצומים בנסיון למנוע הפעלת גוף ציבורי לביקורת על התנהלותם.
מעל ומעבר לכל זאת, חשיבותו של עניין זה עכשווית ודחופה, לנוכח הראיות הברורות להתנהלות דומה של קבוצה גדולה של אנשי משטרה ופרקליטות במשך שנים בפרשת רומן זדורוב, והתנגדותה של פרקליטות המדינה לעיון בכתבים בתיק זדורוב נ מדינת ישראל (7939/10) בטענות דומות של הזכות לפרטיות... [3]
לפיכך, אודה על תשובתך לגבי עמדתה העקרונית של פרקליטות המדינה בעניין ציבורי חשוב זה.
