2018-02-25 Open letter to Prof Alex Stein, Brooklyn law school, upon his election as justice of the Israeli Supreme and in view of integrity crisis of the Israeli courts


מכתב פומבי לפרופ' אלכס שטיין לכבוד הבחרו לשופט בית המשפט העליון ולנוכח משבר היושרה בבתי המשפט בישראל
המכתב שנשלח היום, מציין את אבדן אמון הציבור בבתי המשפט בישראל, וכן את הסילוף השיטתי ("פברוק) בכתבי בתי המשפט.  המכתב גם מתייחס לחוות דעתו של פרופ' מוטה קרמניצר לגבי מצב מערכת החוק והמשפט בישראל בעקבות משפט רומן זדורוב, ולמאסרם ללא הליך ראוי של רומן זדורוב והבלוגרים לורי שם-טוב ומוטי לייבל, שמחו על שחיתות בתי המשפט לענייני משפחה בישראל. המכתב מבקש את תגובתו של פרופ' אלכס שטיין: כיצד יפעל לתיקון המשבר ביושרת בתי המשפט בישראל? המכתב גם נשלח בתפוצה רחבה לפרופסורים למשפטים בבתי ספר מובילים בארה"ב.

RE: Open letter, upon your election as justice of the Israeli Supreme Court and in view of integrity crisis of the Israeli courts
Dear Prof Stein:
Congratulations upon your election as a justice of the Israeli Supreme Court!
As a concerned Israeli citizen, I would like to update you regarding conditions in the Israeli courts today:
  • Poll after poll shows that the vast majority of Israelis have lost trust in the Israeli courts. [1]
  • The 2013 UN Human Rights Council Periodic Review of Israel notes: “Lack of integrity in the electronic records of the supreme court, the district courts and the detainees courts in Israel”.
  • The 2018 UN Human Rights Commissioner’s Periodic Review report notes: “24. HRA-NGO highlighted the serious deterioration in integrity of law and justice agencies as a consequence of the implementation of e-government systems. It affirmed that the validity and integrity of any legal and judicial records of Israel should be deemed dubious at best.” [2]
  • Numerous examples have been documented of falsified (“fabricated” in Israeli parlance) decision records, published by the Israeli Supreme Court, and newly appointed Supreme Court Presiding Justice Esther Hayut has so far failed to initiate corrective actions. [3]


  • All decisions and judgments of the Supreme Court since 2002 are rendered “subject to editing and phrasing changes”.
  • In relationship to the Roman Zadorov affair, senior Israeli law professor Mordechai Kremintzer wrote: “"Conduct of the State Prosecution is scary… The Zadorov murder trial is an indictment of the State Prosecution. Combined with conduct of the Supreme Court and the Attorney General, we have a justice system, which is primarily engaged in protecting itself."
  • Appeal in Zernik v State of Israel et al (7631/17) addresses falsification of judicial records in deprivation of liberty – confinement of bloggers Lori Shem-Tov and Moti Leybel, who protested corruption of the family courts, and Roman Zadorov. The Supreme Court imposed sealing on the court file with no due process of law, and refuses to remove such sealing, regardless of repeat requests and a protest letter by the Association for Civil Rights in Israel. The Supreme Court has also failed to rule in the case so far. [4]
I and other Israeli citizens would be grateful for any response, indicating in what ways you may address the integrity crisis of the Supreme Court and the Israeli justice system.
